REPLY TO COPYRIGHT OBJECTION/DISCREPANCY

By registering a copyright, the author of the work gets legal protection. But during the registration process of the copyright, an objection from third parties may arise. Or the Examiner might find a discrepancy. Such objection/discrepancy must be replied to within the stipulated time for the creator to keep the copyright, and the Reply must be professional and legal and to-the-point. WHAT IS A COPYRIGHT OBJECTION?

A copyright objection can be filed by third parties within 30 days from the date of issue of the diary number. If no objection is filed, the application moves on to the Examiner for scrutinization.

In case an objection is filed, the Copyright Department sends a Letter to both the parties to which the parties must reply. If the Registrar is not satisfied with the reply against the copyright objection letter, a hearing might be called so that the objections can be settled. The Registrar then decides whether the copyright application would be accepted or rejected. If accepted, it moves to the Examiner.

WHAT IS COPYRIGHT EXAMINATION REPORT?

  • After the copyright registration application is submitted and examined by the examiner, an examination report is sent to the applicant. It is also put up on the copyright office website along with details of the copyright application.
  • The applicant or the authorized agent then gets a chance to submit a reply to the examination report with a rebuttal if there is an objection by the trademark examiner.
  • The response is then considered, and if the objection can be waived off based on the applicant’s response, then the copyright application gets accepted for registration.
