Madrid Protocol is administered by the World Intellectual Property Organisation (WIPO), headquartered in Switzerland.

WHAT IS THE PROCESS TO GET AN INTERNATIONAL REGISTRATION?

  • An International Application is filed for the trademark (preferable with the help of a trademark attorney, Form-48). The International Application is submitted under Form MM-2(E) with India marked as the Office of Origin.
  • If the foreign country is the US, Form MM-18 (E) is used for the same purpose, whereas for a European country, the Applicant must choose a second language.
  • The Registrar upon receiving the forms and the application will examine if the application fulfils the requirements of the Madrid Protocol.  If passed, the application is moved to WIPO.
  • At WIPO, the application is examined again before forwarding it to the concerned country’s government for registration as per the law of their land.
  • The foreign government then processes the application and communicates through the Indian Government.

HOW TO REGISTER TRADEMARK IN THE USA?

To get a trademark registered with the US Patent and Trademark Office (USPTO), the Applicant can submit the application separately to the Office. The US trademarks are governed by the Lanham Act, and there are separate provisions as to registration of International Trademarks.

As opposed to India, in the US, a trademark is given priority based on the ‘first to use’ rule, rather than ‘first to file’. It is written that the precise use of a trademark gets priority over the filing date. Also, the US trademark system takes into account the use. This means that a mark which has the ‘intent to use’, or which has been used within 5 years from registration, would be given the utmost priority.

  • Registration Process
    For a foreign trademark to register in the US, following are the four “filing basis” out of which one or more must be provided to the USPTO-

    Use in commerce –
      (S. 1(A)): If the trademark is used for trade of goods and services.

    Intent to use (S. 1(B)): If there is an intention to use the trademark within the upcoming 4-5 years.

    Foreign Application (S. 44 (d))
    : Foreign application which has been filed within the previous 6 months.

    Foreign Application (S.44 (e)): Trademark which has already been registered in the original country.
  • The trademarks are categorised into one or more of the 45 classes based upon the goods and services provided under them.Once the application is filed, it is examined as per the US laws, and is accepted or rejected accordingly.
  • If accepted, the trademark gets a protection of 10 years in the US, which can be renewed later. The trademark can also be rejected if it is not used for 5 years after the registration.
  • The renewal of a trademark can be done up to 6 months from the date of expiry of the trademark, by paying the statutory fee to the US Ministry of Economy. The renewal is also published in the trademark journal.

A trademark applicant always has the choice to register the trademark in a foreign country separately. For that, the owner of the trademark must get help from a trademark attorney who is proficient in international registrations and understands the laws of the foreign country.

What is trademark class?
