What is a design?

Under the Indian laws, a design have been defined as “only the features of a shape, pattern, configuration, composition, or ornament of lines or colors that are applied to any article that is two dimensional, three dimensional, or both by an industrial process or any means whether mechanical, manual or chemical, separated or combined, which in the finished article are judged solely by the eye; but is not taken into account upon the principle of construction or anything which is in substance a merely mechanical device.”

By getting a design registered, the applicant can get an exclusive right over any design created using any industrial process. This legal protection is provided for ten years and can be extended for the next 5 years after the expiry.

WHAT IS THE ELIGIBILITY FOR A DESIGN TO GET REGISTERED?

  • The design must be new and original.
  • It should not have been disclosed to the public before the filing date or the priority date.
  • The design must be significantly distinguishable from the other known designs.
  • The design must not contain any scandalous or obscene matter.

WHAT IS PROCESS OF DESIGN REGISTRATION?

  • The application is filed using the Form 1 and the particulars about the applicant are submitted along with the form.
  • The applicant must provide the name of the article to which the design has been applied.
  • If a design is two dimensional, two copies each showing all the sides of the design must be submitted with the application.
  • For a design which is being registered in more than one class, an application for each class must be submitted separately.
  • A novelty statement providing the mechanical process, trademarks etc. must be given along with each representation of the design.
  • The application is examined by the Patent Office once all the documents are submitted along with the prescribed forms and fees.
  • The design is registered after the removal of the objection to the application.

  • Details of the inventors: Name, Nationality, Address;
  • MSME certificate Scan copy (If applicant is small firm)
  • BOARD RESOLUTION (If applicant is a Pvt/Public Ltd. Co)
  • Drawings of the Design: Front view, Back view, Side View, Perspective view, Front perspective view, Top View, Bottom view;

WHAT IS THE DIFFERENCE BETWEEN A DESIGN AND A TRADEMARK?

Design Trademark
Protects the physical appearance of the product.
Protects the symbols used to identify the brand of the product.
Protects any new and innovative ornamental design of an article of manufacture.
Protects a word or words, name, symbol, or drawing used in commerce to distinguish one source of goods or services from that of another.
